Magazine Agreement

ORIGINAL CONTRACT LANGUAGE for contribution of article to national magazine.

Dear AUTHOR:

The terms of our agreement are as follows:

I. You agree to write a story for us on the subject of “TOPIC” (the “Work") which is scheduled to appear in the DATE issue of MAGAZINE. MAGAZINE will pay you FEE upon acceptance of the Work for publication. The kill fee, in the unlikely event that one is called for, will be KILL FEE.

  1. With the exception of agreed upon fees and subject matter, this agreement shall cover the Work and pieces published after the date of this agreement.

  2. You agree to grant to MAGAZINE all rights in the Works including, but not limited to, all rights, title and interest throughout the world, and the right to procure copyrights in the United States of America and throughout the world, it being agreed that these are works made for hire as that term is defined by the Copyright Act effective January 1, 1976.

FINAL CONTRACT LANGUAGE AFTER NEGOTIATIONS

Dear AUTHOR:

The terms of our agreement are as follows:

  1. You agree to write a story for us on the subject of "TITLE" (the "Work") which is scheduled to appear in the DATE issue of MAGAZINE. MAGAZINE will pay you FEE upon acceptance of the Work for publication. The kill fee, in the unlikely event that one is called for, will be KILL FEE.

  2. With the exception of agreed upon fees and subject matter, this agreement shall cover the Work.

  3. You agree to grant to MAGAZINE a non-exclusive license to the Work to exercise any and all of the rights granted by the Copyright Act of the United States and the copyright laws of other countries, not limited to the right to reproduce, display, distribute, sell, and translate the Work throughout the world, in any media no known or later developed.
